Purpose of This Document

This Nominee Verification Policy defines the complete process by which EternaSafe handles nominee access requests following the activation of the Inactivity Trigger. It forms part of EternaSafe's Terms of Service and Privacy Policy. It exists to protect users from fraudulent claims, protect nominees from liability, and provide a clear, transparent process for all parties.

1. Overview

When a User's account becomes inactive for a defined period and all User alert attempts fail to receive a response, EternaSafe's Inactivity Trigger activates. This initiates a structured, multi-step nominee notification and verification process. Access is never automatic and is never granted without verification and admin oversight.

This Policy defines: what constitutes acceptable proof of events; what verification nominees must complete; what timeline applies; how disputes are handled; and how EternaSafe protects against fraudulent claims.

2. The Inactivity Trigger — Complete 12-Step Sequence

3. Acceptable Proof of Death or Incapacity

3.1 In the Event of Death

Nominees must submit at least one of the following documents, clearly showing the User's name and date of death:

  • Death Certificate — issued by the Municipal Corporation, Gram Panchayat, or competent authority
  • Court Order — confirming the death of the account holder
  • Cremation or Burial Certificate — where a death certificate is pending
  • Hospital or Medical Certificate of Death — signed by a registered medical practitioner
  • Newspaper death notice — as supplementary evidence only, not as primary proof

3.2 In the Event of Incapacity

Where the User is alive but incapacitated and unable to manage their account, nominees must submit:

  • Medical Certificate — issued by a qualified and registered medical practitioner, clearly stating the nature and extent of incapacity
  • Court Order — declaring the User incapable of managing their affairs (e.g., under the Mental Healthcare Act 2017 or relevant guardianship law)
  • Power of Attorney — if applicable, giving the nominee authority to act on the User's behalf

3.3 Pending Documentation

If a nominee cannot immediately provide complete documentation (e.g., death certificate is pending registration), EternaSafe may, at its sole discretion, grant temporary provisional read-only access pending receipt of complete documentation within 30 days. Provisional access may be revoked if documentation is not received.

4. Nominee Identity Verification

Every nominee must verify their own identity before receiving access. The following government-issued IDs are accepted:

  • Aadhaar Card (preferred — for OTP-based verification)
  • PAN Card
  • Passport
  • Voter ID Card
  • Driving Licence

The nominee's submitted ID must match the name and contact details registered by the User in the Nominee Section. If there is a discrepancy, EternaSafe may request additional supporting documentation.

6. Scope of Nominee Access

6.1 What Nominees Can Do

  • View all records and notes within the account
  • Read legacy notes and personal messages
  • Individually download documents uploaded by the User
  • Take screenshots of content for personal reference

6.2 What Nominees Cannot Do

  • Edit or delete any account contents
  • Bulk-download all files simultaneously
  • Share access credentials with another person
  • Access the User's Unlock Password (which EternaSafe does not hold)
  • Use account contents as legally binding documents without appropriate legal process
  • Modify nominee designations or account settings

6.3 Access Revocation

EternaSafe reserves the right to revoke nominee access at any time if fraud is suspected or confirmed, documentation is found to be falsified, a court order requires suspension, or multiple conflicting claimants emerge pending legal resolution.

7. Handling Disputes Between Nominees or Claimants

7.1 Multiple Nominees

Where a User has designated multiple nominees, all verified nominees receive access simultaneously. Each nominee's access is independent. EternaSafe does not adjudicate allocation of assets between nominees — that is a matter for legal succession.

7.2 Disputes from Third Parties

If a third party (non-nominee legal heir, family member, or other claimant) disputes the nominee's right to access, EternaSafe will:

  • Acknowledge the dispute within 48 hours
  • Suspend nominee access pending review where the dispute involves prima facie legal grounds
  • Request documentary evidence from all claimants
  • Not adjudicate the dispute — EternaSafe is not a court or legal authority
  • Resume or reinstate access only upon receipt of a court order or a verified legal settlement

7.3 Appeals Process

If a nominee's access request is rejected, the nominee may appeal by:

  • Emailing support@eternasafe.in with subject line "Nominee Access Appeal"
  • Providing additional documentation supporting the request
  • EternaSafe will review the appeal within 14 working days
  • If the appeal is unsuccessful, the nominee may seek appropriate legal remedy through Indian courts

8. Fraud Prevention

EternaSafe takes nominee fraud seriously. We reserve the right to:

  • Conduct enhanced due diligence on any access request where fraud is suspected
  • Cross-verify documentation with issuing authorities where possible
  • Request video verification of a nominee's identity
  • Cooperate fully with law enforcement and regulatory authorities investigating fraudulent claims
  • Pursue legal remedies against any person who fraudulently obtains access to a User's account

Users are encouraged to:

  • Review and update their nominee designations regularly
  • Inform nominees of their designation and the verification requirements
  • Designate nominees they fully trust with their most sensitive personal and financial information

9. Governing Framework

This Nominee Verification Policy forms part of EternaSafe's Terms of Service and Privacy Policy. It is governed by Indian law. EternaSafe's role is that of a messenger and information facilitator — not a legal authority, probate court, or succession adjudicator. Nothing in this Policy creates any legal right over a User's assets in favour of any nominee.
