2. Nature of the Platform

2.1 What EternaSafe Is

EternaSafe is a secure digital information storage and controlled-release platform. It enables you to:

• Store life-critical personal, financial, and business information in an encrypted account
• Organise this information across structured sections (Legacy Notes, Assets Guide, Business & Income Continuity Guide, Helpful Contacts, Nominee Section)
• Designate trusted Nominees who receive read-only access upon verified trigger activation
• Protect all information using zero-knowledge encryption such that it is not ordinarily accessible to EternaSafe under the current architecture

2.2 What EternaSafe Is NOT

EternaSafe is also NOT:

• A banking or financial services provider
• An insurance broker or financial advisor
• A legal document drafting service
• A dispute resolution authority for succession or inheritance claims
• Responsible for errors in information that you enter

3. Eligibility

To use the Platform, you must be at least 18 years of age, be a resident of India or a person whose data will be processed within India, and have the legal capacity to enter into a binding contract under Indian law.

4. Account Registration and Security

4.1 Registration

You must register with a valid Indian mobile number. One person may maintain only one account. You agree to provide accurate information and to update it as necessary.

4.2 Your Unlock Password — Your Sole Responsibility

You are solely responsible for:

• Choosing a strong Unlock Password and storing it securely offline
• Keeping your Recovery Key in a safe location, separate from your Unlock Password
• Not sharing your Unlock Password with anyone, including EternaSafe support
• All consequences of losing your Unlock Password or Recovery Key

4.3 Recovery Key

EternaSafe does not retain copies of Recovery Keys and cannot regenerate, recover, or retrieve lost Recovery Keys. The Recovery Key is generated once, shown to you once, and thereafter exists only where you have stored it.

4.4 Account Security

EternaSafe will never ask you for your Unlock Password via any channel. Any such request is fraudulent. Notify us immediately at support@eternasafe.in if you suspect unauthorised access.

5. Your Account — Storage and Acceptable Use

5.1 Your Content

You retain full ownership of all information you store. EternaSafe claims no ownership over your account contents. By using the Platform, you grant EternaSafe only the limited technical right to store and transmit your encrypted data as necessary to operate the service.

5.2 Acceptable Use

You must not store content that is illegal under Indian law, evidence of a crime or fraud, content belonging to minors, or information you do not have the right to store. Because of our zero-knowledge encryption, EternaSafe is technically unable to monitor your account contents. You bear full responsibility for the legality of what you store.

5.3 Storage Limits by Plan

5.4 Service Availability

EternaSafe does not guarantee uninterrupted, error-free, or continuous service availability. The Platform may be temporarily unavailable due to scheduled maintenance, technical failures, or circumstances beyond our reasonable control. EternaSafe does not guarantee:

• Uninterrupted or continuous service availability
• Error-free operation at all times
• Immediate resolution of technical issues
• Availability during scheduled or unscheduled maintenance windows

Service disruptions do not affect the security or integrity of your encrypted account contents. In the event of extended downtime, we will communicate through our website and registered contact details.

6. The Inactivity Trigger

6.1 How the Trigger Works

The Inactivity Trigger is a sequential, multi-step process with multiple safeguards. Any login at any point in the sequence immediately cancels the entire process. The complete trigger process is defined in our Nominee Verification Policy, which forms part of these Terms by reference.

In summary: after a defined period of inactivity, EternaSafe sends you multiple alerts across available channels. Only after all alerts go unanswered does it notify nominees. Nominees must then complete identity verification and admin review before access is granted. Nothing is automatic. Nothing is without oversight.

6.2 Plan Differences

6.3 Cancelling a Triggered Process

Any successful login automatically cancels the trigger process. You may also contact support@eternasafe.in with your registered mobile number to manually cancel.

6.4 False Trigger — Limitation of Liability

EternaSafe takes all reasonable steps to prevent false triggers. However, EternaSafe shall not be liable for a trigger activating because you were unreachable due to travel, illness, or technical issues with your mobile or email service. You are responsible for keeping your contact details current on the Platform at all times.

6.5 Nominee Access — Scope

Verified nominees receive read-only access to your account contents. They can view and individually download documents. They cannot: edit or delete any content, bulk-download, print remotely, share access with another person, or access your Unlock Password. Access is time-limited.

7. Nominee Designation

7.1 Designation

You may designate up to 3 nominees depending on your plan. You are responsible for informing nominees of their designation, ensuring contact details are current, and reviewing designations as your circumstances change.

7.2 Nominee Verification Policy

The complete nominee verification process — including acceptable proof of death, proof of incapacity, identity verification requirements, review timelines, appeals process, and fraud prevention controls — is set out in our Nominee Verification Policy, which forms part of these Terms by reference.

7.3 Fraudulent Claim Protection

EternaSafe reserves the right to:

• Request additional documentation from any nominee before granting access
• Suspend nominee access requests that appear suspicious or unverifiable
• Reject claims where documentation cannot be satisfactorily verified
• Conduct enhanced verification reviews on any access request
• Cooperate with law enforcement or regulatory authorities where required
• Reverse nominee access if fraud is discovered after access has been granted

8. Subscriptions, Payments, and Refunds

8.1 Plans and Pricing

EternaSafe offers a Free Plan and four paid Subscription plans. Features are described at www.eternasafe.in/pricing. We reserve the right to modify plan features or pricing with 30 days' prior notice to existing subscribers.

8.2 Payment

Paid Subscriptions are processed through Razorpay. All prices are in Indian Rupees (INR). By subscribing, you authorise payment of the applicable fee.

8.3 Renewal

Annual plans renew automatically unless cancelled. You will receive a renewal reminder at least 14 days before renewal. The Lifetime plan is a one-time payment with no renewal.

8.4 Cancellation

You may cancel at any time through account settings. You retain access to Paid Plan features until the end of the current billing period. Your account reverts to the Free Plan at end of period. Account contents remain intact subject to Free Plan limits.

8.5 Refund Policy

• Annual subscriptions: non-refundable after 7 days from payment
• Refund requests within 7 days will be considered case by case
• Lifetime plan: non-refundable after 14 days from payment
• Refunds, where applicable, processed within 10 business days to the original payment method
• To request a refund: email info@eternasafe.in with registered mobile number and transaction ID

8.6 Platform Discontinuation — Lifetime Plan

If EternaSafe discontinues the Platform entirely, Lifetime plan subscribers will receive a pro-rata refund calculated on the basis of months remaining in a 10-year service period from the date of purchase, subject to a maximum refund of 50% of the original purchase price. All active annual subscribers will receive pro-rata refunds for unused subscription periods. We will provide at least 90 days' advance notice before any discontinuation.

9. Data, Security Architecture, and Our Obligations

9.1 Architecture Representation

Based on the current architecture, EternaSafe does not have access to users' vault encryption keys and cannot ordinarily access vault contents. We commit to maintaining this architecture. If future changes affect these characteristics, we will provide 30 days' advance notice and update our Privacy Policy and Terms accordingly.

9.2 Our Data Obligations

• Maintaining AES-256 encryption on all vault contents at all times
• Storing all data on servers within India (AWS Mumbai Region) under the current architecture
• Maintaining a full audit trail of all account events
• Notifying you of any data breach involving operational data within 72 hours as required by DPDPA 2023
• Not selling, renting, or sharing your data for commercial or advertising purposes

10. Intellectual Property

All technology, design, branding, and proprietary systems of the EternaSafe Platform are owned by Eternasafe Technologies Private Limited and protected under Indian intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for personal, non-commercial purposes. Your account contents remain entirely your own intellectual property.

11. Limitation of Liability

11.1 What We Are Not Liable For

• Loss of account contents due to forgotten Unlock Password or lost Recovery Key
• Loss arising from information you entered incorrectly
• Family disputes, succession conflicts, or legal proceedings arising from account contents or nominee access
• Loss or damage arising from a false trigger caused by your failure to maintain current contact details
• Consequential, indirect, or special damages arising from use of the Platform
• Actions taken by nominees in reliance on account contents
• Financial losses arising from reliance on account contents as a legal document

11.2 Our Maximum Liability

Our maximum liability shall not exceed the total Subscription fees paid by you in the 12 months preceding the event giving rise to the claim. For Free Plan users, our maximum liability shall not exceed INR 1,000. Nothing in this clause limits our liability for death or personal injury caused by our gross negligence, fraud, or any other liability that cannot be excluded under Indian consumer protection law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Eternasafe Technologies Private Limited, its directors, employees, and agents from any claims, damages, losses, or expenses arising from: your breach of these Terms; your violation of any applicable Indian law; any information you store that infringes a third party's rights; or any claim by a nominee, family member, or legal heir arising from your account contents or nominee designations.

13. Account Termination

13.1 Termination by You

You may close your account at any time. Upon verified deletion request: all account contents are permanently deleted within 30 days; all operational data deleted within 30 days (except legally required audit logs); any active Subscription cancelled with no refund for the remaining period; nominees notified that their designation has been removed.

13.2 Termination by Us

We reserve the right to suspend or terminate your account if you violate these Terms or we are required to do so by applicable law. In the event of termination by us without cause, we will provide 30 days' notice and a pro-rata refund of any prepaid Subscription fees.

13.3 Platform Discontinuation

If EternaSafe discontinues the Platform entirely: we will provide at least 90 days' advance notice; provide a mechanism for you to retrieve your encrypted data before shutdown; issue pro-rata refunds for prepaid Subscription fees; and Lifetime plan subscribers will receive refunds as described in Section 8.6.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of India, including the IT Act 2000, DPDPA 2023, Indian Contract Act 1872, and Consumer Protection Act 2019.

14.2 Grievance Redressal

14.3 Dispute Resolution

Any dispute that cannot be resolved through the grievance process shall be subject to the exclusive jurisdiction of courts located in India. You and EternaSafe agree to attempt good-faith negotiation before initiating formal legal proceedings. Nothing in these Terms limits your rights as a consumer under Indian consumer law.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Nominee Verification Policy, constitute the entire agreement between you and EternaSafe regarding the Platform.

15.2 Modifications

Material changes will be communicated to registered users via SMS or email at least 14 days before the change takes effect. Continued use of the Platform after the effective date constitutes acceptance.

15.3 Severability

If any provision of these Terms is found to be invalid or unenforceable under Indian law, the remaining provisions shall continue in full force and effect.

15.4 Force Majeure

EternaSafe shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, government actions, power failures, or internet infrastructure failures.
